General Terms and Conditions (GTC) for Heartbreak Escapes (BLACOON Retreats AS)
§1 Applicability of GTC
These general terms and conditions apply to all declarations of intent, contracts, and legally binding actions of Heartbreak Escapes (BLACOON Retreats AS) (including affiliated companies and vacation homes) with its members and guests. Deviating terms from the member or guest do not apply.
1.1 Definitions:
"Member": A person who has entered into a contract with Heartbreak Escapes (BLACOON Retreats AS) and is entitled to use the services. "Guest": Persons invited by a member who share the stay in the vacation home with the member. "Contract": The agreement between Heartbreak Escapes (BLACOON Retreats AS) and the member covered by these GTC.
§1.2 Online Contract Conclusion
Membership and the associated contract are concluded upon confirmation of these general terms and conditions (GTC), the privacy policy, and the right of withdrawal information.
§1.3 Right of Withdrawal
The member has the right to withdraw from their online membership within 14 days of contract conclusion without providing a reason, in text form (via email or letter). This 14-day right of withdrawal expires upon the first booking of a vacation home or the first login into the online community.
§1.4 Miscellaneous:
No oral agreements exist. Any changes or additions to this contract must be in writing. This also applies to any waiver of the written form requirement. If provisions of this contract are or become invalid or impossible to enforce, the validity of the remaining provisions will not be affected.
§2 Contract Commencement and Payment Start
The contract becomes effective upon payment and the first login into the online community. The use begins on the 1st of the month following contract conclusion.

§4 Pet Policy
It is allowed to bring one dog, with a shoulder height of 30 cm or less. Alternatively, two dogs with a shoulder height of less than 30 cm may be brought.
§5 Payment Method
All payments must be made in advance. The membership fee for each month is due by the 3rd of the following month.

§6 Membership Terms
§6.1 Validity of Membership
Membership is valid from contract conclusion and payment, with the membership fee always to be paid in advance for the following month and due by the 3rd of the following month. The chosen membership period is 12 months. This will automatically renew for an additional 12 months unless canceled in writing before the contract expires.
§6.2 Termination
The termination must be in writing and sent to [email protected] at least 3 months before the contract expires. With timely termination, membership ends at the expiration of the contract. Extraordinary termination is only possible in justified cases (long-term illness with a doctor’s certificate), but only before the membership/vacation home use takes place.
§6.3 Withdrawal and Cancellation
Withdrawal from the contract can be made within 14 days of contract conclusion without providing a reason. After the deadline has passed, the right of withdrawal expires. Cancellations after this period are subject to the termination conditions in §6.2. Upon the first vacation home booking or first login into the online community, the right of withdrawal expires and the membership takes effect.
Cancellation (for Heartbreak Escapes only):
- Up to 8 weeks before arrival: 100% of the payment will be refunded. Example: For a payment of 200 €, you get back 200 €.
- 7 weeks before arrival: 75% of the payment will be refunded. Example: For a payment of 200 €, you get back 150 €.
- 6 weeks before arrival: 50% of the payment will be refunded. Example: For a payment of 200 €, you get back 100 €.
- 5 weeks before arrival: 25% of the payment will be refunded. Example: For a payment of 200 €, you get back 50 €.
- 4 weeks before arrival: 0% of the payment will be refunded, and the entire remaining amount is due for payment. Example: For a payment of 200 €, the full remaining balance is due.
An extraordinary cancellation is only possible in justified cases (long-term illness, with a doctor’s certificate).
§6.4 Payment Conditions
The membership fee must always be paid in advance for the following month and must be paid by the 3rd of the following month. If payment is not made on time, Heartbreak Escapes (BLACOON Retreats AS) reserves the right to impose late fees or terminate the membership immediately.
§6.5 Payment Delay
If the customer is in arrears, Heartbreak Escapes (BLACOON Retreats AS) has the right to block access to the club’s facilities and services until full payment is received. Heartbreak Escapes (BLACOON Retreats AS) may also terminate the contract without notice after a payment reminder has been sent. In such a case, the customer is still obligated to pay the outstanding amount.
§6.6 Deposit
Heartbreak Escapes (BLACOON Retreats AS):
A deposit of 300 € will be pre-authorized on the guest’s credit card or PayPal account one day before arrival. Five days after departure, the pre-authorization will be released.

Heartbreak Country Club: The deposit for vacation homes is 310 €, paid via PayPal. This amount includes a PayPal processing fee of 10 €, so after fees, 300 € will be refunded as a deposit. The refund will be made within a week after the stay, provided there are no damages or outstanding amounts. Please provide your name and booking number with the payment for easier identification.
§6.7 Liability
Heartbreak Escapes (BLACOON Retreats AS) is not liable for damages occurring from the use of the offered services and accommodations, unless they are due to intent or gross negligence. Members are responsible for their guests and pets.
§6.8 Arrival and Departure
Arrival can take place from 3:00 PM, and departure should be no later than 12:00 PM. We kindly ask our guests to leave the vacation homes in the condition they were found.
§7 Service Description of Heartbreak Escapes (BLACOON Retreats AS)
Heartbreak Escapes (BLACOON Retreats AS) offers the following services:
- Vacation Homes: Each of the currently available homes has individual facilities and features.
- Amenities: All homes are equipped with fully equipped kitchens, living rooms, and private outdoor areas. The homes have heating systems for optimal comfort and wood stoves for extra coziness. Internet access via Starlink, as well as Amazon Fire Sticks on the devices and various game consoles, are also available.
- Child-friendly: Children under 12 years old stay for free with us, but the number of children must not exceed the home’s maximum capacity.
- Optional Additional Services: Members and guests can order towels and bedding for an additional fee. We also offer a fixed price for firewood, which can be ordered as an add-on. For members traveling with dogs, space can be reserved for the pet.
- Extra Guests: From the third adult person, additional guests can be added for 25 € per night up to one week before the arrival date, provided there is space in the rental property.
§7.1 Heartbreak Country Club
Heartbreak Country Club offers the following services:
- Membership: Exclusive membership options that provide benefits and discounts on bookings and additional services.
- Membership Models: Heartbreak Country Club membership models are designed for 2 people.
- Reservation System: Easy booking and management of stays through an online community.
- Access to Club Polls: The Heartbreak Escapes portfolio is continuously expanding with new properties. Club members have the right to participate in polls and can vote on which properties should become part of the club.
- Transfer and Exchange Options: Members can transfer or exchange stays with other members for flexibility.
- Exchange: The platform provides space for members to exchange experiences, tips, and recommendations.
- Extra Guests: From the third adult person, additional guests can be added for 20 € per night up to one week before the arrival date, provided there is space in the rental property.
- Optional Additional Services: Guests can order towels and bedding for an additional 10 € per person/stay.
§7.2 Membership Options
- Full Membership:
- Stay Nights: 14 nights per year
- Price: 111,11 €* per month
- Included Services: Firewood flat rate, bedding, towels, final cleaning, possibility to bring a dog
- Light Membership:
- Stay Nights: 7 nights per year
- Price: 66,66 €* per month
- Included Services: Firewood flat rate, bedding, towels, final cleaning, possibility to bring a dog

§7.3 Availability
Full membership at Heartbreak Escapes includes 66 available spots with a booking guarantee, and there are 132 limited spots for Light membership. All other interested parties will automatically be placed on a waitlist and will be contacted when space becomes available.
§7.4 Cancellation
The cancellation policy for Heartbreak Country Club is as follows: For cancellations made 8 weeks before the stay, 100% of the days will be refunded, for cancellations made 6 weeks before, 50% will be refunded, and for cancellations made later, the days will be forfeited. We ask for understanding that random and careless bookings blocking the vacation homes at Heartbreak Country Club, with late cancellations, will be sanctioned. The community relies on fair cooperation, and administrators will always monitor this and may impose cancellation fees in the form of a reduction in available vacation nights. Extraordinary cancellations are only possible in justified cases (long-term illness with a doctor’s certificate).
§8 Use of Facilities
The use of Heartbreak Escapes properties is only available to registered members. Members have the right to use the booked vacation homes in accordance with the established terms and conditions.
The following rules apply for use:
- Reservation and Registration: Booking vacation homes must be done in advance. Extra persons or companions must be registered no later than one week before arrival.
- Usage Rights: Members are entitled to use the booked properties during the agreed stay nights. Transferring usage to third parties is only allowed with explicit approval from Heartbreak Escapes (BLACOON Retreats AS).
- Behavioral Rules: Members are obliged to follow the house rules and all applicable laws and regulations during their stay. By booking a vacation home, we assume the house rules are accepted. In the event of a violation of the rules, Heartbreak Escapes (BLACOON Retreats AS) reserves the right to take actions that may result in the termination of membership.
- Liability: Members are responsible for any damages that occur due to their use of the facilities, as well as the behavior of their companions and guests.
§8 Minimum Stay Requirement
The minimum stay for all bookings at Heartbreak Country Club is 7 consecutive nights. Shorter stays are not allowed, and each booking must meet this minimum period.

§9 Prohibition on Reselling Stay Days
It is strictly forbidden to reserve or offer for resale, rental, or any similar commercial purpose the stay days included in the membership. It is also not allowed to profit in any way from stay days without explicit written approval from Heartbreak Escapes (BLACOON Retreats AS). However, it is allowed to sell stay days at cost price to other members if the stay days cannot be used.
§10 Sanctions for Breach of Contract
If the member violates the provisions in §9 (Prohibition on Reselling Stay Days) or other essential contract terms, this will lead to immediate termination of the contract. In such cases, the member loses all rights to the remaining stay days, and a refund of already paid amounts is excluded. Heartbreak Escapes (BLACOON Retreats AS) reserves the right to take legal action in case of misuse or breach of the contract.
§11 Severability Clause
If any provisions of this contract are or become invalid, the validity of the remaining provisions is not affected. The invalid provision will be replaced by a valid provision that is as close as possible to the original intent.
§12 Jurisdiction
Jurisdiction for all disputes arising from or in connection with these terms is Germany, even though Heartbreak Escapes (BLACOON Retreats AS) is based in Norway.
§13 Final Provisions
Heartbreak Escapes (BLACOON Retreats AS) reserves the right to change or supplement the terms at any time. Changes will be sent to the customer in writing. The customer has the right to object to the changes within two weeks after receiving the notice. If no objection is made within the deadline, the changes are considered accepted. In case of protest, the contract is automatically terminated and expires at the end of the contract term. Until that time, the contract remains according to the original terms.
These terms apply to all companies affiliated with Heartbreak Escapes (BLACOON Retreats AS), as well as their respective offerings, services, and affiliated vacation homes. By booking a vacation home, we assume the house rules are accepted.
